A Smith County Grand Jury has no billed a case involving an off-duty Tyler Animal Control officer who in March fatally shot a pit bull that belonged to afamily in Arp.

The incident occurred March 25 on Forrest Street and the Arp Police Department investigated it. At the time, the department’s Assistant Police Chief Johnny Vargas said they were interviewing witnesses to the shooting, and didn’t provide additional information.

Don Martin, Tyler Police Department public information officer, confirmed the person involved in the shooting is an animal control officer with the city who was off duty at the time of the incident. The officer's work duties were not modified after the shooting, Martin said.

After the incident, Rose City Pits and Pets, a pit bull support organization, organized a memorial walk in memory of Lulu, the American pit bull terrier who was killed.
