Affidavit: Smith County jail corporal assaulted, pursued, fired gun at man

SMITH COUNTY (KYTX) - According to an affidavit, the Smith County jail corporal who was arrested recently assaulted a man whom he claims stole a ladder.

Brandon J. Owens, 25, was charged with aggravated assault and deadly conduct in the Christmas Day incident. He was immediately suspended from the department and resigned Friday.

In an investigation by Texas Ranger Brent Davis, Owens pointed a semi-automatic firearm at a man and hit him in the upper back and neck. A .40-caliber pistol was identified as the weapon.

Owens also chased the man, who was driving a Ford Explorer, in a Ford pickup. The two vehicles wrecked on Greenbriar Road, disabling Owen's truck. The other man fled the scene when Owens fired a shot after the collision, the affidavit reported.

The offenses occurred during Owens' off duty hours and are not related to his employment with the Smith County Sheriff's Office.

Warrants were issued Friday by 241st State District Judge Jack Skeen Jr. Bond  was set at $350,000 for the aggravated assault count and $150,000 for deadly conduct.

Owens was suspended at 7 a.m. Jan. 1 upon arriving for duty at the Smith County Central Jail. 

The case is being investigated by the Smith County Sheriff's Office and the Texas Rangers.
