Appeals court upholds life sentences for former Gilmer Pastor on child sex crimes

GILMER (KYTX) – The Sixth Court of Appeals in Texarkana has upheld six life sentences after a jury convicted a former Gilmer Pastor last year of indecency with a child, and aggravated sexual assault of a child.

Hugo Fluellen, of Gilmer was sentenced in October 2013 by Upshur County District Judge Lauren Parish.

On August 15, 2014 the appellate court denied Fluellen's appeal after he claimed the trial court erred in accepting his pleas because he was not properly admonished and his plea was not entered knowingly and voluntarily.

The jury heard evidence that Fluellen was a preacher and began touching his victim when she was in the second grade, Witness testimony indicated Fluellen would often molest his victim on the way home from church after she had attended the church and sang in the choir. Hugo molested his victim up until 2012 when he was arrested.

Today the victim is 18 years old.

In a statement from Upshur County District Attorney, Billy W. Byrd, said DNA evidence was offered that established the defendant as the father of the victim and the father of the victim's baby.

The life sentences were stacked Judge Parish.
