Entertainment News: "Wizard Of Oz" munchkin dies

(CNN) - In Entertainment News, one of the last surviving munchkin's from the original production of "The Wizard of Oz" has died. 

Margaret Pelligrini played the flowerpot munchkin and one of the sleepy head kids in the classic 1939 movie.

Her death leaves just two surviving munchkins, including lollipop kid Jerry Maren who's 93-years old and 95-year old Ruth Duccini.

Pelligrini was 89-years-old.

(CNN) - Usher could be in for another custody battle. 

The singer's ex-wife has filed an emergency motion seeking custody of their two children. This comes after the couple's oldest son almost drowned at Usher's Atlanta home Monday.

In the motion, filed Tuesday, mother Tameka Foster said the five-year-old was "hospitalized in intensive care." 

A hearing is set for Friday afternoon. Usher won primary custody of the kids last year after a bitter court fight. 

(CNN) - Actor Thomas Guiry, better known as "Smalls" from the classic movie "The Sandlot" was arrested in Houston last weekend for head-butting a police officer.

The incident happened at a Houston airport. According to police, United Airlines employees reported an unruly passenger whom they said was too drunk to board the plane.

The officer told Guiry he could avoid going to jail if he agreed to go to a sobering center. Police say the actor refused and then resisted arrest. 

The 32-year-old actor now faces a felony charge for assaulting a public servant.
