Upshur Co. man sentenced to 165 years in child sex assault case

Upshur County man found guilty on sexual assault of child charges Thursday afternoon.
 
Obie Earl Tutt, II, 38, of Ore City was found guilty of Aggravated Sexual Assault of a Child and Indecency With a Child
 
A Upshur County Jury was selected Monday, Nov 14 in the case of the State 
 
Trial started on Wednesday morning with testimony and presentation of evidence presented by District Attorney Billy W. Byrd.
 
Local attorney Matthew Patton called the Defendant to the witness stand prior to closing its case.
 
Arguments were made by counsel with a verdict of guilty to two separate 1st Degree Felony offenses of Aggravated Sexual Assault of a Child and four separate 2nd Degree Felony offenses of Indecency with a Child at approximately 3:33 p.m.
 
The punishment phase of the trial started late Wednesday afternoon and finished around noon on Thursday.
 
At approximately 3:00 p.m. the jury returned a sentence of 165 years in the Institutional Division of the Texas Department of Corrections along with a $40,000.00 fine.
 
The charges arose from two separate young girls from the Ore City area.
