(KYTX) - There are 24 states that require the employers to allow an employee to be released from employment and without any kind of a docking of their pay. Some of those states require that you give notice, West Virginia in fact requires written notice of your request to leave work, and most of them require that it's out of necessity.

According to attorney and legal analyst, Diana Crutchfield, in about half of the nation employers have to give time off with pay. That's the case if working hours don't permit a visit to the polls on Election Day.

West Virginia's law dates back to the 19th Century and has no previous court cases to provide case law. It makes the employee take responsibility to notify the employer.

Crutchfield went on to say military personnel either on active duty... or recently separated from active duty in a number of states... may request registration up to the day before Election Day.
