Rusk County jury convicts woman of criminally negligent homicide

HENDERSON (KYTX) - A Rusk County jury has found a woman guilty today of two counts of criminally negligent homicide.

According to Rusk County District and County Attorney Micheal Jimerson, a jury needed two hours' deliberation to find Ashley M. Kubiak guilty of the state jail felonies. She faced up to two years in state jail, but the jury sentenced her to 180 days probated. A judge set Kubiak's punishment at five years' probation.

"The defendant was looking down at a text resulting in a collision where she turned a vehicle into oncoming traffic causing death and horrific injuries," Jimerson said in a statement. "I appreciate the jury holding the defendant accountable. I respect the jury's decision extending mercy for the defendant, but everyone was moved by the tremendous suffering and courage of the victim's family."
