UPDATE: (KYTX) - May 8, 2014 at approximately 9:00pm, Thomas Kyle Wagoner was apprehended by Deputies with the US Marshals Service. Wagoner was located at a residence in Frio County, Texas.
He was transported to Medina County Jail in Hondo, Texas where he currently awaits extradition back to Cherokee County Jail.
A second individual was arrested at approximately 3:00am May 9, 2014 and was charged with Permitting or Facilitating Escape, a 3rd Degree Felony.
That individual's name is not being released at this time, pending arraignment.
The investigation is still ongoing, and it is not known at this time if more people will be charged, or if those in custody will have more charges brought against them.
23 year old Thomas Kyle Wagoner is in custody this morning. The Cherokee County Sheriff's Department tells CBS19 US Marshals arrested him around 9 last night in Hondo -- that's in South Texas. We don't know how he ended up there or when Wagoner will be brought back to East Texas.
UPDATE: CHEROKEE COUNTY (KYTX) - Law enforcement is still searching for 23-year-old Thomas Kyle Wagoner, the inmate that walked away from the Cherokee County Jail Wednesday night.
His criminal record includes theft, evading arrest, and minor drug charges. He has been in the Cherokee County Jail since March 1.
Jail administration tells CBS 19 he was an "outdoor trustee" meaning his duties around the jail allowed him to go outside the gated and secured areas. We are told his job was outdoor maintenance, which included cleaning front offices, taking out the trash, mowing the yard, and washing cars.
Outdoor trustees are only supposed to come in and out of the secured doors at certain times, but jail administrators say for certain jobs they come in and out of the doors often.
A warrant for Wagoner's arrest was put out Wednesday night. We have not yet been told what punishment he faces for escape.
According to a press release from the Cherokee County Police Department, Thomas Kyle Wagoner, 23, was an outside trustee and had regular access outdoors.
He's described as a 6'3" white male weighing 220 pounds with brown eyes and brown hair.
Police say he has family scattered across Cherokee county, as well as Frankston, Troup and Whitehouse.
