UPDATE: Nacogdoches Co Sheriff Office- The Nacogdoches County Sheriff Office has concluded its investigation into the disappearance of a 15 year old juvenile who was found in Lubbock, Texas on February 26, 2014. The juvenile was reported by her mother on February 24, 2014 when she did not return from school. The Nacogdoches county Sheriff Office launched an investigation into the disappearance of the 15 year old juvenile after receiving the report that she was missing.
During the initial part of the investigation sheriff investigators found a potential suspect that was identified as Juan Arenas Delacruz who is an illegal alien. During interviews with family members and friends it was believed that the suspect took the juvenile against her own free will and left in a Volkswagen Passat silver in color. Sheriff investigators spoke with witnesses who stated that the juvenile had made mention that she was afraid of the suspect and what he would do to her.
With the initial information received during the early part of the investigation, sheriff investigators believed that the juvenile had been kidnapped by the suspect and was possibly in imminent danger. On February 25, 2014 an Amber Alert was issued on the juvenile and a warrant was issued for the arrest of the suspect, Juan Delacruz for the charges of Kidnapping.
Sheriff Investigators were able to track down a cell phone number to the suspect which enabled law enforcement authorities to start tracking his phone. With the information obtained, authorities were able to track the suspect to the area of Lubbock, Texas. Working with the FBI, Texas Department of Public Safety and the Lubbock Police Department the suspect was apprehended on 02-26-2014 in Lubbock, Texas at a construction site. The subject was taken into custody without incident. A short time later the juvenile was located in Lubbock, Texas inside a motel room not far from where the suspect was found.
The juvenile was transported back to the sheriff office the following day by the Nacogdoches County Sheriff Office. Since that time, the Nacogdoches County Sheriff Office has been conducting a thorough investigation into the case.
The victim in this case has been interviewed on four different occasions and we have received different accounts of the story each time. The suspect in this case has also been transported back to the Nacogdoches County Jail where he has also been interviewed.
We believe that the victim in this case did go with the suspect voluntarily, but we also believe that the victim may have felt pressured to go with the suspect. The suspect who is 27 years of age has had a fixation on this victim for several months. We can definitely see where he has manipulated her during this time.
After reviewing all the facts of the case, the Nacogdoches County Sheriff Office has issued warrants for the charges of Enticing a Child a 3rd felony and Sexual Assault of a child a 2nd felony. The Sheriff Office will be dropping the charge of Kidnapping. The Sheriff Office has gained a confession from the suspect of a sexual assault of a child charge that occurred in Nacogdoches County.
Sheriff Jason Bridges stated that due to the inconsistent statements of the juvenile that the Sheriff office has decided not to pursue the kidnapping charges. At the conclusion of this investigation, we feel that the elements of the offense support the charges of enticing a child and the sexual assault of a child that also occurred.
Enticing a Child charge is defined as a person entices, persuades or takes a child younger than 18 years of age from the parent or guardian without their consent.
Sheriff Jason Bridges also stated that the suspect, Juan Delacruz also has a pending hold on him from the border patrol and expects more charges to be filed in Lubbock, Texas on Delacruz for crimes that occurred there while the suspect had the juvenile.
We are very glad and fortunate that the victim has returned home safe and we will continue to monitor her wellbeing. Child Protective Services is also assisting in this investigation.
