Family members also told police Randall had beaten up his father several times in the past.

An East Texas man sits in the Smith County jail Monday night accused in the death of his father. And witnesses tell investigators the two had a history of domestic disturbances. In fact we've learned 28-year-old Randall Britton just spent time in jail a few months ago for assaulting a different family member.

56-year-old R.L. Britton was found dead in the laundry room of his Chapel Hill home just before two Monday morning by Smith County Sheriff's deputies. It happened in the 3700 block of Jackson Avenue. They were responding to a call by his 28-year-old son Randall Britton who is charged in his murder. The two lived there together. Catherine Brown lives next door. "It was just a shock to everyone when they woke and saw what happened this morning," she told us, "he's going to be missed in the neighborhood, I know that, because he was a very good neighbor."

Smith County Sheriff Larry Smith says investigators knew this was a homicide based on injuries. "There was some trauma to the facial area," he told us.

But they don't exactly know how the victim died. Sheriff Smith said, "there was no murder weapon found at the scene. We will not know what weapon was used until after the autopsy."

As for why there were no witnesses. But neighbors tell investigators this isn't the first time there was trouble at this home. "There was some history of the son and dad being in altercations before," he said.

And Smith County court documents show Randall Britton pleaded guilty to assaulting a female family member in April and he was sentenced to 45 days in jail.

Randall Britton is being held in the Smith County Jail on $150,000 bond.
