Upshur County sex offender gets 40 years on child sexual assault charge

UPSHUR CO. (KYTX) - On Tuesday, February 5, 2014, 35-year-old Casey Lee Phillips pled guilty to aggravated sexual assault of a child and received 40 years in prison without appeal.

Upshur County District Attorney Billy W. Byrd said Phillips must serve at least a half of the sentence before becoming eligible for parole. Additionally, if released, he must register as a sex offender for life.

The case arose out of an investigation headed by the Harrison County Sheriff's Office and the Hallsville Police Dept. The evidence showed that in 2010 the defendant lived in the Diana portion of Upshur County. The crime occurred one time in Upshur while the child was nine years old.

The child was taken to a sexual assault nurse examiner after the allegations arose in Harrison County in late 2012 and was later taken to the Children's Advocacy Center in Longview where a forensic interviewer took a statement from the child.

The defendant was indicted for the offense November 8, 2013 by an Upshur County Grand Jury.
