Child killed in Tyler crash

TYLER (KYTX) - A deadly car accident in Smith County just before 4:30 this afternoon kills a young boy and sends his mother and two young siblings, ages 1 and 8, to the hospital.

It happened on Gallion Road near County Road 381 in Smith County when the mini van the family was in struck a tree.

Several neighbors heard the crash, and rushed to help the family.

One man, who was too upset to talk to us on camera, says he tried to save the boy's life.

Others say it was a scary sight to see.

"I was in the back bedroom and heard a bang, well I thought it was a shotgun going off next door," says Andre Woodbury.

Woodbury was at home when he heard a wreck on GallIon Road behind his house.

"I got on the phone and called 911, my wife went down there, she was consoling people," says Woodbury.

By the time Woodbury got to the road, another neighbor was trying to save a 5-year-old boy inside the car.

"He was in there holding this boy that was in very bad shape.  He had a very faint pulse," says Woodbury.

The boy's mother, Sylvia Moreno, was driving this gold mini van with her 3 children inside, when Troopers say she veered off the road, and slammed into a tree.

"My wife was holding the baby in the car seat making sure it was ok, it was really a mess because she couldn't help," says Woodbury.

First responders say the boy was behind the drivers seat, wearing only a lap belt when the wreck happened.  And they say he was not in a booster seat required by law.

"The oldest boy in the front seat doesn't have a brother anymore," says Woodbury.

The mother, Sylvia Moreno, was treated and released from Trinity Mother Frances Hospital.

We do not know the conditions of the other 2 children at this time.

The child booster seat law requires parents to put children over the age of 4, until the child is 4'9'' tall, in a booster seat.

They are also required to have a lap and shoulder belt fastened over the child. 

That law went into effect last year.

A traffic accident at Gallion Avenue in Tyler has claimed the life of a five year old boy.

It happened about 4:30 PM Thursday. The vehicle, driven by the child's mother, Sylvia Moreno, was also carrying two other children - an eight year old and a one year old. The vehicle ran off the road and crashed into a tree. The child was pronounced dead at the scene from massive head and internal injuries.

The boy was only wearing the lap portion of a seatbelt. By law, he should've been strapped into a booster seat. DPS has not elaborated on any charges Moreno might face.

Police are still looking into why the vehicle left the roadway.
