Update: Truvia indicted for first-degree murder in Smith County

TYLER (KYTX) -- Byron Truvia has been indicted on a first-degree murder charge for the death of his teacher at John Tyler High School in September 2009.

On March 22, Truvia turned 18, and since that day he has been confined to the Smith County Jail. CBS 19 reported in March that the defense and the Smith County district attorney filed a joint motion to declare Truvia not competent to stand trial. At that time, the judge ordered Truvia to be sent to a state mental health hospital.

But, a week later, Truvia turned 18, and was sent back to Smith County and jailed. Now, a grand jury has indicted Truvia for the murder of his teacher, Todd Henry.
 
Truvia's attorney, Jim Hugglar, told CBS 19 that while there is an indictment, he expects Truvia to be sent back to Vernon State Hospital, where he'll remain for a very long time. "There is a joint motion to find him not competent pending before the district court. I expect him to go back to the hospital once the judge signs the motion," Hugglar said.

That motion is currently before Judge Christi Kennedy. Until that's signed, Truvia will remain behind bars. He is being held on a $1,000,000 bond.

Calls to Smith County district attorney Matt Bingham were not returned.
