UPDATE: Judge declares mistrial in injury to child case

UPDATE: (TYLER MORNING TELEGRAPH) -  Judge Christi Kennedy has declared a mistrial in this case.


 

SMITH COUNTY (TYLER MORNING TELEGRAPH) - Jurors in the Smith County 114th District Court wiped their eyes this morning as they saw photos of a bruised 14-month-old baby being examined at the Children's Medical Center in Dallas.

Prosecutors showed the photos to the jury as Dr. Matthew Cox, a pediatrician who specializes in child abuse at that hospital in Dallas, testified in the second day of the trial for Brian Fredzell Pringle, 44. Pringle is charged with injury to a child and faces up to life in prison if he is convicted.

Cox testified before the jury that the baby had suffered paralysis on the left side of her body after suffering strokes and damage to the right side of her brain as a result of injuries she received on Sept. 5.

The photos showed bruises on the baby's buttocks and thighs, which extended down to her knee. Cox testified that the baby could not have received the injuries from accidental falls as the child's mother had testified on Tuesday.

"They were not consistent with falling down," he said.
