UPDATE: Hasan Expected to Enter Plea Tomorrow

Posted: Updated:

UPDATE (KCEN) -- Maj. Nidal Hasan is expected to enter his plea for his charges in another pre-trial hearing that has been set for August 15 at 1 p.m.

Hasan says he is not ready to enter his plea because he hasn't been able to speak with his closest family member, who will not be in from out of the country until Thursday.

If Hasan pleads guilty, the panel selection process will not begin until after Monday.

A pre-trial hearing has been scheduled for Friday as well.

(KCEN) -- Maj. Nidal Hasan showed up to court for his pre-trial hearing today still wearing a beard, which is against military dress code.

Hasan was found in contempt of court for a fourth time, fined $1,000 again and was removed from the room to watch court proceedings via video.

During the hearing Judge Gross denied the defense's motion for him to reconsider the continuance. This means the trial will begin as scheduled.

The judge also denied the defense's motion to exclude the prosecution's terror expert testimony in the case.

An announcement came today saying the Court of Appeals for Armed Forces denied the defense's writ for Judge Gross to recuse himself from the case.

The defense also asked for one of the prosecutors and one of the paralegals to be disqualified from the trial because of prosecutorial misconduct. They watched a DVD which was restricted and not to be used by prosecutors or law enforcement.

The DVD gave instructions on how to get panel members that are partial to the death penalty.

Judge Gross is waiting to rule on this request.

A half-day administrative pre-trial hearing was held this morning. The trial is set to begin on August 20.
