WINONA/SMITH COUNTY (KYTX) - It has been a week since Jake Kimbley's body was sent to Dallas for an autopsy but it is going to be a while longer before we know what the medical examiner has to say about how exactly he died.
Today's report was called inconclusive, but instead of being an end ,it is just the beginning of figuring out what happened that day.
Investigators stayed at the Kimbley home through the weekend sifting through evidence that could lead to the truth when it comes to how 2-year-old Jake ended up dead in the septic tank.
Now, the yellow tape is gone and the detectives are back at the office, but a week's worth of autopsy work hasn't brought the kind of clues they were hoping for.
"Pending simply means that there's more tests that they want to do. There's more information they need to draw a conclusion. It's not that uncommon," Smith County Justice of the Peace Mitch Shamburger said.
Shamburger is ultimately responsible for determining the basics of Jake's death, and he says, in this case, he's relying heavily on that autopsy.
"Sometimes they pend for a month. Sometimes I've had them pend for several months." Shamburger said.
In the simplest terms, it all comes down to whether Jake died by accident or whether he was murdered.
Court documents filed last week say Jake's parents, David and Sabrina, are suspects in the investigation.
And once again, we do not know how long we will have to wait to hear what the medical examiner has to say about those results. We can tell you that coming up Thursday, there is a hearing scheduled for the five children who were taken out of the Kimbley home by CPS a week ago. That hearing is going to decide whether they stay in foster care or whether there's a chance they could go back to the family, whether that's with their parents or some kind of relative.
