Murder trial for former Longview public safety communicator set for Nov. 26

LONGVIEW/GREGG COUNTY (KYTX) - The trial of Harry Chester Goodan, a former Longview public safety communications supervisor charged with fatally shooting his wife in December 2010, is specially set for Nov. 26 in Gregg County's 124th District Court.

Jamie Ellyn Goodan, who was a Longview police officer, was gunned down in her home at Towne East Apartments on Dec. 11, 2010. Police said Harry Goodan called police and reported that he shot his wife. He is out of jail on $75,000 bond.

On Tuesday, his attorney, Jason Cassell, filed several motions in 124th District Court. His motion to suppress evidence asks 124th District Judge Alfonso Charles to consider suppressing three cell phones and a computer seized from Goodan's apartment four days after the homicide. The phones and computer were seized by police with a search warrant, and Cassell believes investigators had no "supporting facts or description why the cell phones or computer constitute evidence."

Cassell also filed a motion asking that the Gregg County District Attorney's Office list witnesses and their criminal histories.

"This information is necessary for the defense to properly prepare for trial, to exercise his allotted peremptory strikes intelligently, and to impeach the state's witnesses," Cassell stated in court records. "Absent a witness list and a criminal history concerning each witness, the defendant will be deprived of his state and federal constitutional rights, as well as due course and due process of law under Texas Code of Criminal Procedure Art. 1.04, 1.05 and 1.051(a)."

No hearing date has been set by Charles to consider Cassell's motions.

Ellyn Goodan's surviving father, Jimmy Rice, has spoke publicly in support of Harry Goodan, testifying on his behalf in January 2010 when a judge reduced Goodan's original $500,000 bond to $75,000.
