Stay of Proceedings Issued in Accused Fort Hood Shooter Case

(KCEN) -- The Army's highest court, the Unites States Court of Appeals for the Armed Forces (CAAF) has granted a stay of proceedings in the case against accused Fort Hood shooter Nidal Hasan.

A former stay was lifted last week when the lower court, The Army Court Of Criminal Appeals (ACCA) , upheld Judge Gregory Gross's order to have Hasan forcibly shaved.

The ACCA found that his beard, which violates Army dress code, is not a true religious expression.

The court also upheld a former ruling not to recuse Judge Gross on the grounds that he is allegedly biased.

Hasan's lawyers filed the motion for the stay with the CAAF on Friday, and it was granted this morning.

The court clerk says the stay will be granted until further action by the court.

They expect a writ from Hasan's lawyers regarding his beard.
