Woody Wallace , Constable Precinct 1 in Trinity Co., denies accusations in civil lawsuit

TRINITY COUNTY (KYTX) - A civil lawsuit was recently filed in state court against Woody Wallace, Constable Precinct One, Trinity County. Constable Wallace vehemently denies all accusations made against him in this lawsuit, all of which are false, frivolous, and made with no intention other than to try and influence the 2012 Sheriff's election. The people bringing these false charges announced in December of 2011 that they would file a civil suit prior to the general election if there was a chance Constable Wallace would win the election. In fact, even before he was served with court documents, copies were being distributed throughout the county by hand and also being posted on Facebook by these same individuals. Since this case was filed, it has now been removed from state district court and into a federal court of law in Lufkin.

Without going in detail (and in an effort to protect the identity of the minor who has brought these false charges), it should only be noted that: while working a football game, Constable Wallace was informed by two citizens that they had been offered drugs by a juvenile and soon after, they witnessed the same juvenile make a drug sale to a minor. These citizens did their civic duty by informing law enforcement and school officials of the activity. The
minor was pointed out as he was leaving the game, so Constable Wallace made contact with the adult that was accompanying the minor. It was felt that the minor had ingested
some form of drug, so the adult was strongly urged to seek immediate medical attention for him.

Contrary to the allegations in the lawsuit, the minor was not illegally detained or illegally searched, nor were any constitutional rights of he or his guardian violated in any manner. Constable Wallace's actions were solely to protect the minor from harm, given concern over ingesting drugs. It is the duty of any police officer to protect children from harmful
situations and to act in accordance with the law by investigating the illegal sale of prescription/dangerous drugs. Constable Wallace did what was required by law and any disciplinary action taken by the school district was in accordance with school policy.

As a law enforcement officer, Constable Wallace will not knowingly allow the sale of dangerous drugs to any child and will make every reasonable attempt to protect children
from these types of situations. As a parent, he hopes that someone would likewise intervene if one of his own children were about to knowingly or unknowingly inflict harm to themselves.
