UPDATE: James Calvert to be brought back to Smith County

UPDATE: The Ouachita Correctional Center tells CBS 19 James Calvert signed a waiver of extradition in Friday's hearing. That means he has chosen not to fight the extradition proceedings. He should be transported to the Smith County Jail early next week, at which point he will be will be formally charged with Capital Murder in the death of his ex-wife Jelena Sriraman.


OUACHITA PARISH, LA (KYTX) -- The Smith County man accused of murdering his ex-wife and kidnapping his 4-year-old son was in an extradition hearing Friday morning to determine when and how he'll be brought back to East Texas for prosecution.

The West Monroe, Louisiana police department told CBS 19 that 41-year-old James Calvert had been largely uncooperative leading up to the hearing. A representative with the Ouachita Parish District Attorney's office said Friday's hearing was being held at the jail. She didn't know whether Calvert was fighting the extradition effort or agreeing to it.

On Thursday Smith County District Attorney Matt Bingham told CBS 19 a decision to fight the extradition could result in a lengthy delay that would keep Calvert in Louisiana through the end of next week. Bingham said if Calvert goes along with it he could be back by Monday.

Bingham also took time to give credit to a large number of agencies that worked together to capture Calvert Wednesday night. He said investigators from his office, the Tyler Police Department, the Smith County Sheriff's Department, FBI, U.S. Marshals all deserved credit for quickly finding the man and insuring the safety of 4-year-old Lucas Calvert.

Calvert faces a Capital Murder charge once he's returned to Smith County.
