Charges recommended against driver of 18-wheeler in Thanksgiving Day fatal

The Texas Department of Public Safety says they are recommending that criminally negligent homicide charges be filed against the driver of an 18-wheeler that hit the back of an SUV on Thanksgiving Day, killing the occupants. 

Vincent Leggio, Sr., and Debra Leggio were both killed in the accident. 

Loxahatchee, FL resident Richard Fernando Kerr was the driver of the 18-wheeler owned by C.R. England, INC. The tractor trailer plowed into the back of the SUV that authorities say was stopped on the road because of other accidents on the highway that were caused by heavy fog.

DPS says 29 people total were injured in 18 separate crashes.

Trooper Chuck Havard tells 12News it is now up to the Jefferson County District Attorney's Office to determine whether they will file charges against Kerr.

The family of the victims Thursday filed a civil suit against both the driver and the company owning the 18-wheeler.
