Smith County deputy charged with failing to report child sexual assaults

SMITH COUNTY (TYLER MORNING TELEGRAPH) - A 15-year veteran of the Smith County Sheriff's Office has been arrested and has resigned his position after an investigation uncovered the deputy and his wife failed to report the sexual assaults of family members under the age of 13 and a child at school.
The deputy, a detective with the department, and his wife were both arrested last week on the misdemeanor charge of failing to report child abuse or neglect.

According to an affidavit by Texas Ranger Brent Davis, the detective and his wife both knew a family member under the age of 17 had sexually assaulted two younger family members multiple times and failed to report the crimes.

The affidavit also states the couple knew the juvenile assaulted a fellow class member at school and also failed to report the crime.

According to Davis' report the child at school was assaulted both on a school bus on multiple occasions and in the bathroom of the band hall at the school.

Davis stated in the report that a tipster contacted the Texas Department of Family and Protective Services which touched off the investigation.

The couple was released on $7,500 bonds each and sheriff officials say the detective tendered his resignation the following day.
