Court rejects Rusk County mother's appeal in daughter's killing

TEXARKANA/BOWIE COUNTY (KYTX) - The Sixth Court of Appeals on Friday rejected Jessica Bain Carson's appeal on her capital murder conviction from Rusk County.

In April 2011, Carson was convicted by a Rusk County jury of torturing and killing her 13-month-old daughter, Amora Bain Carson. She received life without the possibility of parole.

Jurors had the option of finding Carson guilty of two lesser offenses, but her appellate lawyer argued that the court should have submitted additional options for lesser offenses. The appellate court agreed, but it also found that, since the jury rejected the submitted lesser offenses, it would have been an error for the jury to proceed to an even lesser offense. Therefore, any such error was harmless, the Sixth Court of Appeals determined, according to a media release from Rusk County District Attorney Micheal E. Jimerson.
