Child endangerment trial for Kimbleys delayed

TYLER (KYTX) -- The child endangerment trial for Sabrina and David Kimbley was delayed Tuesday after new information became available to the couple's defense attorneys.

The Kimbleys were indicted on 26 counts of child endangerment in August of 2012 following the death of their son Jake and subsequent discovery of his body inside the family's septic tank. Prosecutors said the ensuing investigation revealed a roach-infested home that was inadequate for caring for Jake's five living siblings.

In a hearing in Smith County's 241st District Court, Assistant District Attorney Cynthia Kent told Judge Jack Skeen Jr. that Child Protective Services recently completed a 1,097-page report on the Kimbley's five living children. Kent also said a psychological evaluation on one of the children had become available.

Kent said the prosecution was ready to begin a trial for the child endangerment charges against the Kimbley's, but she acknowledged that the defense would need more time to review the massive amount of additional evidence they were about to receive in the case.

Defense attorneys Reeve Jackson and Zachary Davis asked for an extension in the case.

Judge Skeen said he would review all the documents, redact them and then distribute them to the defense. Skeen also set a pre-trial hearing for the Kimbleys on Friday, May 3 at 9:00 a.m. The trial was set for Monday, June 3 at 10:00 a.m.

The Kimbleys have a separate civil case pending in the Smith County 321st District Court. That case seeks to establish a permanent custody plan for the couple's five living children. The Kimbleys have, for the time being, lost all parental rights while they're in the Smith County jail.

The Kimbleys also remain suspects in an ongoing murder investigation into Jake's death. Assistant District Attorney Jason Parrish said he had no updates on that investigation Monday.
