Defense of Marriage Act hearing today

WASHINGTON, D.C. (CBS) - The Supreme Court Justices will take- up the Defense of Marriage Act today, which stipulates marriage is between one man and one woman.

Yesterday, the Justices heard arguments about California's ban on same-sex marriage. Court observers say the Justices appear reluctant to make a major ruling on same-sex marriage. As for the Defense of Marriage Act, sometimes called DOMA, it also bars the federal government from recognizing same-sex marriages -- even in states where it's legal.

A new CBS News poll shows 60-percent of Americans want that provision changed. Proponents say the Defense of Marriage Act is necessary to protect children. 

(SOT: )"I think it would hurt children because children do best in an environment when they're raised by a mom and dad, " says  Liberty Counsel's Mathew Staver.

Same-sex marriage supporter James Duffy says, "I'm hoping Supreme Court dumps DOMA because it's unconstitutional."

The Court isn't expected to issue a ruling for either same- sex marriage case until June.
