EXCLUSIVE: Family reacts after Tyler officer no-billed in shooting

SMITH COUNTY KYTX - The Tyler police officer involved in a deadly January shooting will not be charged.

22-year-old Victor Fuentes was shot and killed at his home on queen street in Tyler January first.

Thursday, a Smith County grand jury no billed Tyler Police Officer Matt Riggle for the shooting. An investigation into Fuentes' death has been going on for months. The shooting happened during a New Year's Eve celebration this year.

Tyler police say they got a call just after the start of the new year about gunshots coming from Queen Street in North Tyler.

Victor's family members spoke with CBS19 after the shooting and said the gunshots did not come from their home. However, police say they saw shots coming from the back of the Fuentes house and found more than 50 shell casings there.

Police say they went in through the back door and repeatedly told Fuentes to drop his gun. Police say Fuentes refused and Officer Riggle had to open fire in self defense.

We talked exclusively to a member of Victor Fuentes' family after the news of the No Bill. She did not want to be named but says her family is extremely hurt to hear the news.

"All I wanted was for us to get justice any way or another, and the truth to be known because it's not right. Everybody's upset and we're trying to figure out what to do. We're going to try to find something to do about it."

She says her family is still trying to figure out a way to find justice for Victor. She says they have an appointment at the courthouse later this month.

Since the shooting, Officer Riggle has been reassigned to administrative duty, pending the outcome of the grand jury investigation.

He will remain on administrative duty until the department's administrative investigation is over. That is expected to come to an end next week.

Tyler police are not making any comments about the jury's decision.

 

 

A Smith County grand jury returned a no-bill in the New Year's shooting that claimed the life of Victor Fuentes as he celebrated the New Year holiday.

Smith County District Attorney Matt Bingham told the Tyler Paper this morning the grand jury, after hearing evidence in the case, did not indict Tyler Police officer Matt Riggle when they met Thursday.

Matt Bingham said that his office has attempted to contact members of the Fuentes family to inform them of the grand jury's decision.
