Former NISD substitute faces another charge after third student comes forward

NACOGDOCHES (KYTX) — Former Nacogdoches schools substitute Jamar Ballard, 29, faces a third charge of improper relationship between an educator and student after a third student said she had sexual intercourse with him.

The Nacogdoches High School student said she had sexual intercourse with Ballard in late March at a local hotel. Including this latest accusation, Ballard has been charged with one count of sexual assault of a child and three counts of improper relationship between an educator and student.
"If there are any other victims in this case, we encourage them to come forward," said NISD Superintendent Dr. Fred Hayes. "Our students are important to us, and we are offering counseling support for those who are affected."

Ballard first was arrested Thursday, April 11, after a student told an NHS staff member that she had sexual intercourse with Ballard. A second student came forward on Friday, April 12, and said she also had sexual intercourse with Ballard.

NISD performs background checks and takes fingerprints from every teacher, substitute teacher and staff member working for the district.

Prints are collected through a state-mandated vendor, and background checks are performed through the official Texas Department of Public Safety and FBI clearinghouse databases.
"Contrary to recent media reports, we do not use a third-party source when checking for criminal histories of prospective employers," Hayes said.
The human resources department carefully examines the information presented on the background checks before hiring or denying employment to an individual.
"While we, by law, cannot comment on a person's criminal history, we can assure the community that we are taking every possible precaution to protect our students and staff," Hayes said. "Their safety remains our top priority."

Ballard was immediately terminated from employment with the school district.
