Trial of ex-Upshur County commissioner, son postponed

GILMER (TYLER MORNING TELEGRAPH) - The trial of a former Upshur County commissioner and his adult son, accused of holding a state game warden at gunpoint in a confrontation, has been postponed, Upshur County District Attorney Billy Byrd said today.

The case of former Precinct 3 Commissioner Lloyd Allen Crabtee, 52, and his son, Todd Allen Crabtree, 29, was scheduled for jury selection Monday in 115th District Court, but delayed because "there was some additional discovery that neither party had in their possession, that we were getting together," Byrd said.

In legal jargon, discovery is the process in which one side in a case seeks to force the other to disclose certain facts and documents.

Byrd said he anticipated the trial to be reset for "sometime in May," but that Judge Lauren Parish of the 115th District Court hasn't yet set a pretrial hearing.

Lloyd Crabtree was indicted on five felony charges while his son was indicted on three, according to the Texas Parks and Wildlife Dept. The allegations stem from an Oct. 6 incident in which two armed men disarmed and detained Texas Parks and Wildlife Department Game Warden Shane Bailey "while the officer was making a routine check for hunting law violations on private property in Upshur County," department spokesman Mike Cox said in a January press release.

No shots were fired in the incident, which occurred before the elder Crabtree left office as a county commissioner.
