UPDATE: Upshur County jury hands out 13 year prison sentence in burglary case

GILMER (TYLER MORNING TELEGRAPH) - A 115th District Court jury today sentenced Bradley Wayne Shipley to 13 years in prison and fined him $10,000 after convicting him of burglary of a habitation.

Shipley, 28, of Mt. Vernon, was convicted of the Nov. 16, 2012, burglary of the Jose Munoz residence on FM Road 993 in Lafayette community, according to the Upshur County District Attorney's office. Shipley pled not guilty, and testified in the case.

During the trial's punishment phase, District Attorney Billy Byrd introduced evidence of several prior convictions Shipley had in Gregg and Upshur Counties for offenses ranging from failure to comply with sex offender registration requirements to aggravated sexual assault of a child and indecency with a child.
Byrd said that due to one of Shipley's prior convictions, the punishment range for the burglary offense would be 5 to 99 years in prison and a fine of up to $10,000.
Trial Judge Lauren Parish overruled defense attorney Matthew Patton's objection to Byrd's introduction into evidence of Shipley's juvenile record in Gregg County.
The 7-man, 5-woman jury deliberated only about 30 minutes before finding Shipley guilty, Byrd said.
