Smith County man arrested for 2012 murder

TYLER (Tyler Morning Telegraph) - A Smith County man is behind bars in connection with a 2012 murder case which began when a woman reported her brother missing last September.

Anthony Joseph Miller, 69, is charged with the shooting death of Adam John Palacios, 33, who was reported missing in September by his sister. His wife later told deputies his main source of income "is running drugs."

An arrest warrant affidavit states detectives were called to Miller's home on County Road 35 on September 20 on a reported robbery. However, during the interview, Miller told detectives that he was made to watch two other men take Palacios into Miller's garage and shoot him in the back of the head.

Miller told detectives he was made to clean up the mess and load the body into the back of his own pickup. "Miller advised that he was forced at gunpoint to load the body and clean up the mess," the affidavit states.

Miller then told detectives he followed the other two men to a location near Frankston, where he dragged the body into a wooded area.

A shell casing and blood splatter was found in Miller's home, according to the arrest affidavit, and the autopsy report indicated Palacios was shot once in the back of the neck.

The affidavit further states detectives spoke with the two men Miller said were involved. One of the men stated he owed Palacios $5,800 for drugs, but that Palacios was holding his motorcycle until the debt was paid, according to the affidavit. The other man said he was in the Dallas area. Phone records indicate the two men had extensive phone calls in the Dallas area at the time of the murder. Miller's phone, however, showed he was in the area where the body was dumped.

Earls stated Miller has an extensive criminal history, admitted to being present at the time Palacios was killed, and that he was the one who disposed of the body but did not report it to authorities.

Miller remains in the Smith County Jail this afternoon on a $1 million bond on the charge of murder.
