Former Henderson High School teacher pleads guilty to possession of child porn

TYLER (KYTX) - A former high school teacher with The Henderson Independent School District pleaded guilty to the possession of child pornography in a Tyler federal court Tuesday. 42-year-old James Malone has been in custody since January.

Malone entered into a plea agreement with the local U.S. Attorney's office involving the first count of an indictment handed down in March in which he was accused of having at least one image of a child under 12 years old engaged in a sexual act. The charge was at the federal level because the production and distribution of any images found on his laptop stretched across state lines.

Judge Judith Guthrie told Malone that his guilty plea would set into motion a process in which the U.S. Probation Department will investigate the case and determine the facts of the crime and Malone's involvement in it. The probation department will generate a report that makes recommendations on Malone's sentence.

Malone faces up to twenty years in federal prison and a fine of up to $250,000. Guthrie estimated a sentence of eight to ten years based on Malone's criminal history and the nature of the crime.

That report will take 30 to 60 days to complete. After that, Federal Judge Leonard Davis will sentence Malone. He remains in federal custody at various East Texas county jails on a rotating basis.
