Only on CBS 19: Van Zandt County shooting victim speaks, wants justice

VAN ZANDT COUNTY (KYTX) -  Larry Maples is out of the Van Zandt County Jail, after allegedly shooting and killing his wife in March.

Maples allegedly shot his wife, Heather, after finding her in Moses Clemente's bedroom.

Moses Clemente, known as "Mo" says he dated Heather Maples for four years. He says at one point, they were even engaged. But in October of 2012, they broke up.

"I went into the courthouse. Patti, who does the registration, goes, well congratulations, Mo...and I said on what?" said Clemente.

What Mo Clemente didn't realize is that Heather was at the courthouse to get her marriage license. But, it wasn't to him, it was to Larry Maples.

He says it was just a month after they broke up.

"We were like, what is going on, that is not the Heather we know," said Clemente.

Clemente says it was February of this year when he suddenly heard from Heather. He says she wanted a divorce from Larry.

"I said I don't know what to do Heather, but I'll be here as a friend if you ever need someone to talk to," explained Clemente.

Clemente said she took him up on that offer and came to his house one early Sunday morning in March.

He says he was talking to her in his bedroom when Larry Maples appeared.

Clemente says Maples walked into his home through an unlocked door.

"For a minute, I'm in disbelief, is this guy really in my house?" said Clemente.

Clemente says Maples shot him once in the chest.

"I said, I'm a Dad, I have three kids and I have grandbabies. I would like to see my grandbabies grow. Don't do this," explained Clemente.

He then, allegedly, turned the gun on Heather, shooting her multiple times until she was dead.

Investigators say Maples then called 911 and said he had "shot his wife and her boyfriend."

"We have four kids out in this world today with mom and that is not fair," said Clemente.

Clemente says he was shocked when he learned Larry Maples had been released from jail, just three months after being charged with capital murder and aggravated assault with a deadly weapon.

"I'm like, Wow, what world are we living in? You got to be kidding me," said Clemente.

Today, he's telling his story, because he says, he wants justice for Heather.

"The same thing he did to her. I think it should be a life for a life," said Clemente.

Van Zandt County Sheriff Michael Lindsey Ray released a statement saying since Maples was not indicted within 90 days, state law allows him to be released.

The case will be forwarded to the van zandt county district attorney's office when the investigation is complete.

Larry Maples must wear a GPS device while he's out of jail. He can only leave home to visit his defense attorney and his pre-trial release officer.
