Ben Wheeler man indicted for capital murder of wife, attempted murder of alleged boyfriend

UPDATE (KMOO/KYTX) - Larry Maples, 44-year-old of Ben Wheeler, was indicted Tuesday morning for the capital murder of his wife and attempted murder of her alleged boyfriend.

Maples was out on bond just three  months after being charged with capital murder and aggravated assault with a deadly weapon. 

Authorities say the shooting happened around 6 a.m. Sunday, March 24 at a home in the 2600 block of FM 16 near Canton.

 

 


VAN ZANDT COUNTY (KYTX) - Family members of an East Texas woman allegedly killed by her     husband say they are losing faith in the justice system.

 

Larry Maples is accused of shooting and killing his wife, Heather, in March. Wednesday, we learned the case is going before a grand jury on July 30th.

As we reported earlier this month,  Larry Maples was released from jail, just three months after being charged with capital murder and aggravated assault with a deadly weapon.

The Van Zandt County Sheriff said Maples was not indicted within 90 days. State law allows him to be released.

Larry Maples allegedly shot his wife, heather, in March after finding her in Moses Clemente's bedroom.

He's also accused of shooting Clemente in the chest.

Clemente says he was engaged to Heather before she met Maples. Clemente says they were just friends at the time of the shooting.

We spoke to Clemente at his Van Zandt county home in an exclusive interview on July 3rd.

"We have four kids out in this world today without a mom and that is not fair," said Clemente.

He was angry about the release of Larry Maples from the Van Zandt county jail.

"When I found out, I was surprised, shocked and disgusted," said Lori Simpson, Heather's sister.

Heather's sister, Lori Simpson, has been trying to get answers for her family and justice for her sister.

"We've sent emails, we've made phone calls, we tried to rally friends and the public to just help us," said Simpson.

But, she says, her family is finding it hard to get answers out of anyone, from the Van Zandt County Sheriff's office to the district attorney.

"I've left maybe 40 messages for the DA's office, for the sheriff, and I've left message for the Governor's office, I haven't heard from anybody," said Julie Deffert.

Heather's family wants to see Larry Maples back in jail as they wait for the final answer in this case.

"Whatever Heather doesn't have now, he shouldn't get to have. I just want the day in court for everything to come out and then for people to make judgement," said Lori Simpson.

The job of the grand jury is to decide whether it is appropriate to indict or proceed with a prosecution against Larry Maples.

Larry Maples must wear a GPS device while he's out of jail. He can only leave home to visit his defense attorney and his pre-trial release officer.
