Lawyer defends Dewhurst family member in theft case

ALLEN (CBSDFW.COM) – Lieutenant Governor David Dewhurst has received criticism and support after calling Allen Police earlier this month to help out an arrested family member.

Dewhurst placed the call to assist his step-niece, Ellen Bevers, who was arrested for shoplifting.

In the call, Dewhurst is heard saying, "I want to talk to the most senior officer you have where you are right now. My name is David Dewhurst, and I'm the Lt. Governor of the State of Texas."

State Agriculture commissioner Todd Staples and State Senator Dan Patrick — who are both expected to challenge Dewhurst in next year's Lt. Governor's Race — later attacked Dewhurst.

Todd Shapiro, the attorney for Bevers, says the incident was a mistake.

"She had stuff in her grocery cart that were separated from the other groceries that she forgot to scan," said Shapiro. "She made it about three steps past the checkout area and the loss prevention people at Kroger stopped her. Instead of allowing her to put the items back or pay for the items, they took her to jail."

He joined KRLD's Mike Rogers to talk discuss the incident and how it has affected Bevers.
