EAST TEXAS (KTBS) - A court hearing addresses the custody of the baby at the center of a ricin investigation case in East Texas.

While the ricin suspect is expected to be arraigned later this week, her estranged husband was in court Monday fighting for custody of their premature baby.

A family court judge approved Nathan Richardson's request for temporary sole custody of his son, Brody.

Shannon Richardson, who is in federal custody, gave birth on July 4th in Longview, Texas.

The baby was due in October and has been through several surgeries.

Nathan's attorney, John Delk, says the baby's health is progressing and could be released in October.

Last May, Richardson's wife Shannon contacted FBI agents alleging that she had found ingredients to make ricin in the couple's home.

She allegedly told authorities her husband made the ricin and mailed letters containing the poison to Washington officials.

But it backed fired and she was the one arrested.

Richardson was formally indicted by a grand jury in June.

She is scheduled to be in federal court on Wednesday, August 28th in Texarkana, Texas.

Richardson is facing a 3-count indictment accusing her of mailing poisoned letters to President Obama, the New York Mayor and a gun control advocacy group.

The judge is also expected to address the issue of Richardson's competency to stand trial.
