Mixed reactions after Tyler pharmacist arrested for sexual assault of a child

Posted: Updated:

TYLER (KYTX) - A long time Tyler pharmacist behind bars, accused of aggravated sexual assault of a child. 73-year-old James Carey Prosperie was arrested Tuesday afternoon at his Tyler home in the 1000 block of Jeff Davis.

A close friend of Prosperie's family who wants to remain anonymous, tells CBS 19 the child who was allegedly assaulted is a young teenager.

"At 11:13 this morning we came to the residence. We had information that he was here," says Tyler Police Officer Don Martin.

Officers say they saw James Carey Prosperie moving around inside the house.

"When we asked him to come out of the house he would not comply so we used officers along with on duty SWAT officers to secure the perimeter and try to talk him out," Officer Martin says.

They did finally get him out and arrested him around 1 p.m.  Police drove him away through a neighborhood community members call safe and quiet.

"We haven't had any problems with anybody around here," says neighbor Albert Scott.

Scott says James Prosperie was his pharmacist when he owned the Medicine Shop pharmacy on Fifth Street in Tyler.

Records show Prosperie still holds a valid pharmaceutical license that does not expire until November 30, 2014. A family friend tells CBS 19  Prosperie has been filling in for other pharmacists in the area since his shop closed down.

"He's always been a nice guy," Scott says. "Seemed like he's always been a family guy and he came over here and visited me several times and been in the house."

Scott is not the only neighbor surprised by the arrest.

Father of two Danny Tarpley lives four houses down and says, "Never would have suspected a thing. I've met him and he's a nice gentlemen as far as the meetings I've had with him."

However, Prosperie's family friend is not surprised by the allegations. She has known Prosperie for a long time and says he has acted "creepy" and "invaded personal space" on several occasions.

She says, "I am saddened by the situation and feel for his sweet wife who is a good woman, and I'm sure she had no idea what was happening."

That family friend tells CBS 19 Prosperie's wife left the area about a month ago.

Smith County records show that his wife filed for divorce a week and a half ago. The divorce hearing was supposed to be this Friday.

We have been told CPS is investigating the sexual assault incident. Police are not releasing any details on the warrant right now.
