Tyler pharmacist arrested for alleged sexual assault of child released from jail

TYLER (KYTX) - The Tyler pharmacist arrested for the alleged aggravated sexual assault of a child is out of jail on bond.

James Prosperie bonded out of Smith County jail Thursday at 11:34 p.m. according to Smith County Judicial records.

Prosperie was released on a $100,000 surety bond. Under the condition of his bond, Prosperie will have to submit to testing on a weekly basis for the presence of a controlled substance in his body.

Prosperie shall not communicate in any manner directly or indirectly with the alleged sex assault victim.
He was ordered to immediately report to the Adult Probation Department, Pre-trial Release officer, upon release from the Smith County Jail, and remain there until he receives supervision instruction

Also under the condition of the bond, Prosperie is ordered not to go within 500 feet of the person, place of residence, place of business, or any other place where the alleged sex assault victim may be located. He cannot communicate in writing, by telephone, directly or indirectly with the child.

Prosperie is ordered not to use, possess, or consume any alcoholic beverages, illegal drug, or narcotic as a condition of his bond.

On Tuesday, Tyler Police Officers went to Prosperie's home in the 1000 block of Jeff Davis around 11:15 a.m. in an attempt to serve a warrant.

Prosperie would not come out of his home. Officers eventually were able to talk him into coming out just after 1 p.m.
