Affidavit: accused Gilmer murderer "couldn't take it anymore"

GILMER (KYTX) -

The affidavit produced by Gilmer Police investigators as part of Thursday night's investigation into the murder of 29-year-old Cheyenne Green says her death was the tragic end to a domestic dispute.

Gilmer Sergeant Roxanne Warren said Shepherd was at the football game with his wife and his 3-year-old son. But according to the affidavit, Thursday night was also a pre-determined time to hand the boy off to Green--Shepherd's ex, and the boy's mother.

Investigators wrote that Shepherd went to the parking lot to hand the boy off, but there was an "argument between the two and yelling regarding the child."

"There were witnesses at the scene close by who did provide valuable information quickly to law enforcement," Upshur County District Attorney Billy Byrd said.

Byrd said the fact that all this happened in public helped a lot, adding that it was lucky no one else was hurt.

According to the affidavit, the argument ended with Shepherd shooting Green and then calling his wife, saying he had "done something bad and he couldn't take it anymore and that [Green] was dead."

"We certainly know there were some witness contacted after the murder and statements were made," Byrd said. "And those statements were incriminating against himself."

Shepherd's wife allegedly told police she found the boy in the car with Green's body, took him to safety and then called 911.

Byrd said Shepherd left the scene, but turned himself in once the warrant was issued for his arrest. He is being held on $1 million bond.
