Argument that led to Thursday shooting in Gilmer was over child's parental rights

GILMER (KYTX) - The cries of a three-year-old boy could be overheard while police questioned witnesses and guests at a middle school football game.

According to court records, the child was in the back seat of his mom's car when his father, Jonathan Ray Rhepherd, allegedly shot and killed the child's mother, 29-year-old Cheyenne Green, in the Gilmer High School parking lot after an argument.

"They were, I'm assuming, here as spectators," said Gilmer police investigator Roxanne Warren, who in a murder complaint filed in the 115th District Court early Friday, said it was a high school student who noticed Green and Shepherd arguing about the child and who had parental rights to the boy.

Tyler Morning Telegraph reporter Phillip Williams was one of the first people at the scene and saw the body lying next a vehicle in the parking lot.

"Place was swarming with cops," Williams said. "There were several people here, obviously.

Lots of emergency vehicles, Gilmer Police Department, Upshur County Sheriff's Office and the Department of Public Safety."

Gilmer ISD said no students were harmed or threatened in the incident, but as fans who attended Thursday's game were asked to leave the stadium, some parents stepped up to make sure children were safe.

"We had some other children," said parent Tammy Hamlin. "We walked to the front of the school, so their parents could meet them up there, so they weren't by themselves."

Tonight, Shepherd is in the Upshur County Jail on $1 million bond. And his son, now without his mother, is staying with relatives.
