Mother of murder suspect wants evidence returned to her

TYLER (KYTX) - The mother of James Calvert filed a motion Thursday requesting property back from the State of Texas which was seized during the investigation into the 2012 murder of Calvert's ex-wife.

Calvert is accused of killing Jelena Sriraman, kidnapping his young son and then going on the run before being caught in Louisiana.

Included in the request were three firearms seized from the home in which both Calvert and his mother were living at the time of the murder. The murder itself happened at a separate location.

The weapons requested were described as a Ruger 10-22 rifle purchased by Pat Calvert in 1975, a Walther 380 pistol purchased by Pat Calvert in 2011. And a Kel-Tec 9mm pistol purchased by Pat Calvert in 2006.

Calvert's defense attorney, Jeff Haas, had no objection.

Also included in the request were potential examples of digital evidence and digital storage mechanisms. Assistant District Attorney April Sykes said the state would need more time before knowing whether an agreement on those items was feasible. She said the firearms were not likely to be a problem, as long as the state could be satisfied they belonged to her, and not her son.

Judge Jack Skeen Junior asked for a formal order to be written up describing the guns that will be handed over.

This portion of Calvert's case will continue with a hearing on October 17.
