Mistrial Declared in Grisham Trial

UPDATE: October 18, 2013, 4:00 p.m. -- A mistrial has been declared in the case against a Fort Hood soldier arrested in rural Temple while exercising his gun rights.

The jury began deliberations around 10 a.m. on Thursday.

On Friday around 4 p.m., the jury could not come up a verdict.


(KCEN) -- There is still no verdict in the case against Fort Hood Master Sergeant CJ Grisham who was arrested while exercising his gun rights on a rural Temple road.

Master Sergeant CJ Grisham faces a Class B misdemeanor charge of interfering with public duties.

The question for jurors is whether Grisham interfered with police investigating a call, or if he acted as anyone would if an officer tried to take their weapon without asking for it, then restrained him.

In closing arguments, the prosecution painted the picture of an officer responding to a call, unsure about the intentions of the armed man he came face-to-face with.

They said Grisham grabbed his log gun when the officer tried to take it, was argumentative, and had to be told six times to put his hands behind his back.

The defense said police changed their stories too many times. They said Grisham did what anyone would do if someone tried to take their gun, pushed them up against a car, and told another officer they'd asked him to hand over the gun. But that hadn't even done that, they said.

Defense attorney Blue Rannefeld said, "This is right after the officer put a gun to the back of his head. What would an ordinary person do?"

Prosecuting attorney John Gauntt said, "The officer is planning on going home that night and frankly Officer Ermis displayed a lot of restraint."

Grisham's supporters are upset over the way the case has been handled.
