Tyler municipal prosecutor, private attorney arrested for DWI

Part-time municipal court prosecutor and private attorney Joe Murphy was arrested and accused of driving while intoxicated Wednesday night.

The arrest happened around 11:00 the night of the 13th.

Police said Murphy's driving caught their attention on Broadway, just south of downtown. Murphy lives off Broadway and was arrested in front of his house.  CBS 19 is still waiting on an answer regarding whether officers were forced to get a warrant to test his blood rather than using a breathalyzer.

Murphy worked for several years in the Smith County District Attorney's office, during which his duties included prosecuting DWI's. For the last three years he has been in private practice while maintaining a position as a contracted employee for the City of Tyler prosecuting low-level misdemeanors in municipal court.

Last week Murphy's DWI arrest led to a suspension from the municipal court. City Attorney Deborah Pullam said he resigned after being suspended.

CBS 19 also confirmed that Murphy had recently joined the board of a local crime-fighting organization. A source on that board said Murphy resigned following his arrest.

Smith County District Attorney Matt Bingham said he plans to turn prosecution of the case over to the Texas Attorney General's office to avoid a conflict of interest.
