Child dead, others injured in highway 31 rollover accident

TYLER (KYTX) -  A 9-year-old girl is dead and five other people are injured after the vehicle they were in rolled over around 11:10 Friday night on highway 31 near County Road 233.

John Harris Bates, 38 was driving west bound on highway 31 in a SUV when he attempted to pass another vehicle by driving on the shoulder. DPS said, that's when Bates lost control of the vehicle causing it to flip over and hit a tree ejecting the passengers.

The 9-year-old Alexis Bates was pronounced dead on the scene. The male driver Bates was taken ETMC in critical condition. Aside from the girl and the driver, 4 other people were in the car at the time of the accident.

A 37-year-old woman was taken to ETMC, she is in stable condition. Two other children ages 11 and 14 are in stable condition at Trinity Mother Frances Hospital. And an 11-month-old baby was care-flighted to Children's Medical Hospital in Dallas. That baby is also listed in stable condition.

This was a one vehicle accident. Investigators are still looking into what caused the accident. It's not known if alcohol played a role in this accident.
