Court rules East Texas killer of 5 will stay behind bars

SAN ANTONIO (KYTX) - The Fourth Court of Appeals in San Antonio has affirmed the conviction of Kimberly Saenz, the former DaVita nurse accused of poisoning her dialysis patients at a Lufkin Clinic.

In April of 2012, a jury handed down the sentence of 20 years for count one of aggravated assault, 20 years for count three of aggravated assault, and 20 years for count five of aggravated assault to  Saenz. She received a sentence of life without parole for the capital murder charge.

The sentence was maximum for each count.

In her appeal, Saenz cited 21 points of error during her trial. The appeals court overruled Saenz's issues and affirmed the trial courts judgement.
