Bernie Tiede transferred to Panola County Detention, , hires new attorney

(KTBS) PANOLA COUNTY (Panola Watchman)-  Former Carthaginian Bernie Tiede was transported to the Panola County Detention Center late Tuesday evening, Jan. 21, after a bench warrant was issued for his arrest.

District Attorney Danny Buck Davidson told the Panola Watchman that new evidence has surfaced that may change the outcome of Tiede's sentencing.

"I'm not at liberty to discuss it further at this time, but when new things come up that weren't there at the beginning you have to look at them," Davidson said. "There may be events that take place that dictate other things."

Davidson also confirmed that he would be exclusively speaking to The Panola Watchman and KGAS Radio for purposes of relaying information pertaining to the case to the public.

According to a motion to substitute counsel filed in the District Clerk's office on Jan. 17, Tiede has officially requested the court to grant permission for Clifton Holmes to withdraw from acting as his attorney and substitute Austin attorney Jodie Callaway Cole.

The motion was filed specifically regarding The State of Texas versus Tiede in Case No. 1997-C-104 on Aug. 27, 1997 for the theft of between $100,000 and $200,000. According to court documents, the charge is a second degree felony.

The Panola Watchman first reported Cole's desire to appeal Tiede's case in August of 2012 when she first expressed interest in appealing the case to Bernie director Richard Linklater.

Chief Deputy John Depresca said the warrant was issued by District Judge Charles "Brick" Dickerson who handed down the order Friday, Jan. 17.

"The warrant told us to have him in Panola County by January 22," Depresca said.

Tiede was transferred from the Telford Unit in New Boston.

"We don't know how long he'll be here," Depresca said.

According to the Texas Department of Criminal Justice website, Tiede is serving a life sentence and isn't eligible for parole until Aug. 20, 2027, 18 days after his 69th birthday.

Tiede was given his sentence on Feb. 11, 1999 after he was found guilty of murdering the late Marjorie Nugent and hiding her body in a freezer for nine months.
