UPDATE: Remaining charges against Hyena Club killer dropped

UPDATE: Tyler (KYTX) -  Assistant Smith County District Attorneys Jeff Wood and Brian Jiral moved to drop Marquel Scott's aggravated assault charge Monday.

Wood told Judge Kerry Russell the state was satisfied with the minimum of thirty years Scott would spend in prison following his murder conviction.

With no objection from the defense Russell dismissed the aggravated assault case.


 

 

A hearing Thursday re-visiting convicted murderer Marquel Scott's deferred adjudication resulted in a 20-year sentence being added to Scott's criminal record.

Judge Kerry Russell of the Smith County 7th District Court had previously placed Scott on deferred adjudication in a 2011 drug possession case.

Scott's subsequent killing of Keeston Fields in 2012 at the Hyena Club in north Tyler violated the probationary terms of that decision in several ways.

Although Judge Russell decided to adjudicate guilt in the drug possession case and assess the sentence of 20 year, he declined to "stack" the sentence on top of Scott's 80-year sentence handed down in the murder case. Accordingly, Scott's actual sentence has not been extended.

Prosecutors still have the option of trying Scott for an alleged aggravated assault that occurred the same night as the murder.
