UPDATE: GREGG CO. (KYTX) - An East Texas law officer who was arrested on a DWI charge has decided to voluntarily leave his position as Gregg County Precinct #3 constable.

Michael John Baggett who was arrested in Franklin County and charged with DWI stated in a letter Monday he is taking time to take care of personal health and medical needs.

"I believe it is in the best interests of myself, my family, and my constituents for me to take this time to regain my focus and my health. During my absence the duties of my office will be carried out by the Gregg County Precinct #3 Deputy Constables with the assistance of other Gregg County law enforcement officers."

According to Franklin County Sheriff Ricky Jones , Baggett was arrested for driving while intoxicated on Texas Hwy 37 at the intersection of FM 3357 north of Winnsboro.

Jones says the arrest was made during a routine traffic stop for Deputy Brian Gurley who noticed Baggett driving in center of two lanes .

The constable also had an open container in his personal car and was taking into custody without incident.

Sheriff Jones told CBS 19, "this is always a bad deal when you have to arrest someone from another law enforcement agency" .

Baggett was released on a $2,500 bond.
