Tyler man set to die for 1996 slaying loses appeal

HOUSTON (KYTX) - The 5th U.S. Circuit Court of Appeals has denied a death row inmate's claims that he should not be executed because he is mentally challenged.

57-year-old Robert Ladd was found guilty of capital murder and sentenced to death by a Smith County Jury for the 1996 rape and  murder of 38-year-old Vicki Ann Garner of Tyler.

Garner had also been strangled to death before her body was set on fire.

In 1978, Robert Ladd was convicted of murdering a woman and her two children, and then setting her house on fire. After serving 16 years of a 40 year prison sentence, Ladd was released from prison.

Tuesday's ruling by the federal appeals court moves Ladd a step closer to his execution.
