(TYLER MORNING TELEGRAPH) - One man is presumed dead after the boat he was in sank in the Cedar Creek Reservoir Wednesday morning.

"We are no longer in rescue mode, but in a recovery operation at this time," Henderson County Sheriff Ray Nutt said Wednesday afternoon.

A 911 call was made Wednesday morning as one man was able to reach a small island and called for help. The other man on the boat was reported to have drowned on the lake between Seven Points and Gun Barrel City.

Nutt said the male victim is between the ages of 40 and 45 years old and is from the Henderson County area.

"What we think happened is the wind was really high this morning, and a wave just swamped the boat, causing it to sink," he said.

Nutt said he was told there were life jackets int he boat, but said he believes neither man was wearing one when the boat began taking on water.

According to Texas Parks and Wildlife, there were 22 boating fatalities in 2013 in Texas, and 85 percent of the victims were not wearing a life vest.

In Texas all boaters 13-years-old and younger are required to wear a life vest while on the water, but those older than 13 are not required to have a vest on. Every boat is required to ahave a vest available to every person on the boat.
