UPDATE:  CARTHAGE (KYTX) -- Tuesday, Judge Diane Devasto accepted a finding of fact and law that had been jointly filed by Panola County District Attorney Danny "Buck" Davidson and the legal team representing Bernie Tiede.

The result of that action is that Panola County court will resend to the Texas Court of Appeals that Tiede be released with a sentence of time served.

The hearing proceeded with discussion of a bond term which could result in Tiede being released this afternoon.
Bond was set as $10,000.

Convicted murderer Bernie Tiede is back in a Panola County courtroom Tuesday, more than three months after being transferred back to the county jail from his long term confinement with the Texas Department of Criminal Justice.

A brief hearing on February 5, 2014 confirmed rumors that had surfaced in the weeks prior that Tiede would attempt to get a reduction on his life sentence.

Speaking on Tiede's behalf, Austin attorney Jodi Cole told visiting Judge Diane DeVasto in February that "mitigating evidence" had come to light that could affect Tiede's punishment in the 1999 murder trial in which he was found guilty of murdering Marjorie Nugent.

Tuesday's hearing is expected to address at least some of that evidence.
